Article 19 of the LQPD
grants data subjects the right to rectify their personal data. The term
"rectification" encompasses a series of meanings: modification,
correction, integration or update, as well as "completion". In a more
general way, it can be said that the right of rectification responds to the
inaccuracy or the lack of updating or completeness of the personal data related
to the data subject.
The accuracy and completeness of
personal data are very important to data subjects. The personal data stored and
linked usually offer a global image of the person concerned and their personality.
In addition, this data often serves as the basis for third-party decisions
about the data subject.
The processing of incorrect or
incomplete data may lead to potentially serious disadvantages for the data
subject. The right of rectification is also applicable to the data collected
before the entry into force of the LQPD, since the
storage of this data implies that it is still being processed.
